Next Level Storm Shelters Warranty Info

Next Level Storm Shelters (NLSS) will repair the storm shelter manufactured AND installed by us in which water leaks, seeps, or otherwise flows into the shelter (product) from the surrounding ground due to a problem, as solely determined by a representative or agent or NLSS in the construction of the product. NLSS will also warranty shelter from any case of floating due to the accumulation of ground water under the product. In order to be entitled to repair the product under the LIMITED WARRANTY, the purchaser of the product must follow the claims procedure contained herein. 

In the event a representative or agent of NLSS determines the problem is the result of improper installation or maintenance (such as welding or drilling of holes anywhere on the shelter) of the product by the purchaser or a company compensated by the purchaser, instead of NLSS, then this LIMITED WARRANTY shall be void. 

For the LIMITED WARRANTY to remain effective, the purchaser must use the product for its intended use, which use is expressly limited to a storm shelter or underground safe. This requirement is extremely important to the continued coverage under the LIMITED WARRANTY and, therefore, failure to use the product for its intended purpose will void the LIMITED WARRANTY without notice. 

CLAIMS PROCEDURE: 

To make a claim under this LIMITED WARRANTY, the purchaser must notify NLSS immediately upon knowledge of water leaking, seeping, or flowing into the product. Upon notification, a representative or agent of NLSS will physically inspect the product to determine the cause of the leakage, seeping of flow of water is due to a problem in the construction of the product, then NLSS will repair the product at no cost to the purchaser within thirty (30) days of the inspection date by the representative or agent. 

In the event the representative or agent determines the leakage, seepage, flow of water or floating is due to any other cause, including, but not limited to, improper use or improper installation by installer engaged by purchaser rather than NLSS, then the LIMITED WARRANTY shall not apply, and NLSS will have no obligation hereunder, unless the purchaser agrees, in writing, to pay all costs of repair or replacement of the product. 

NLSS shall provide the purchaser with a copy of the LIMITED WARRANTY. This LIMITED WARRANTY shall be the entire agreement between NLSS and the purchaser. 

The purchaser shall not be entitled to anything more, or less, than is expressly contained in the LIMITED WARRANTY. Any statement which purports to be different than, or modify, or expanded, the terms set forth in this LIMITED WARRANTY shall not be effective for any purpose. 

Any implied warranties, including warranties of merchantability and fitness for an express purpose, are expressly disclaimed, in no event shall NLSS be responsible for any losses, including consequential and incidental damages, except as expressly provided for herein. Furthermore, NLSS expressly states that the product is only a method of protection against forces of nature, theft, and NLSS shall in no way whatsoever be responsible for any loss or damage of any type resulting from such forces of nature or theft.

Should it be determined that applicable law prohibits enforcement of any provision of the LIMITED WARRANTY, then, to the extent it is necessary to comply with the applicable law, this LIMITED WARRANTY shall be deemed amended. This LIMITED WARRANTY is in force for the life of the home.

Wooden steps, wooden benches, carpet, fan light combo, and any painted surface.
